We can assume that the motives of Premysl Otakar II in issuing his Jewish statutes
were the same as the motives of Frederick II the Quarrelsome, i.e. that he likely wanted to
ensure the exclusive royal property (the Jews) for himself as against the claims of the Holy
Roman Emperor. This is supported by the circumstance that the Jews in Bohemia and
Moravia were never considered as imperial subjects, but remained at all times under the
authority of the king of Bohemia. By the reign of Přemysl Otakar II (1253-1278), these
Statuta Iudeorum assumed the character of general privileges for the Jewish population
in all of the lands of the royal dominion (Nr. 51).33 It is therefore very noteworthy that it
was Premysl Otakar II who on 23rd of August 1268 directly granted such privileges to the
Brno Jewish community (Nr. 54). The significance of the document itself for the Brno
Jewish community is illustrated by the fact that its original was kept safe as late as in the
middle of the 14th century and was also confirmed by Premysl’s son and successor King
Wenceslas II.34
This group of municipal rights also includes the so-called Prague municipal right
from the end of the 13th and beginning of the 14th century (Nr. 84), but in this case it is
not entirely clear for whom the law was intended, and there are also justified doubts as to
whether it ever came into general effect. Nevertheless, all of these rights have very similar
provisions and differ from one another only in details. They usually include the provisions
of Jewish rights and freedoms. The most frequent are provisions regarding the maximum
interest that can be charged, conditions of testimony before the court, strict punishments
for sexual contacts between Jews and Christians, the lists of items that Jews should not
take for a pledge and the punishment for killing a Jew. Some provisions concerning Jews
also appear in both main versions of Jihlava's rights of burghers and miners, called Iura
civium et montanorum (Nr. 49, 50). Some towns in Bohemia and Moravia, as well as in
neighbouring lands, soon sought to emulate those municipal rights as well as the other
Jihlava burghers' and miners’ rights, granted in 1249, and appealed to them later as to
their own rights. For this reason, the Jihlava rendering of the Jewish statutes became at
that time arguably their most widespread version.35
